Customer Advisory 14-004 Port Congestion Surcharge *Revision*

Port Congestion Surcharge

Dear Valued Customer,

On November 17, 2014, CaroTrans International Inc. (CaroTrans) advised our customers of an amendment to our Port Congestion Surcharge (PCS), issued on May 28, 2014.  In light of recent actions taken by many ocean common carriers, CaroTrans is temporarily waiving the PCS until further notice.

The PCS was implemented in response to the current labor unrest between the International Longshore & Warehouse Union (ILWU) and the Pacific Maritime Association (PMA).  As you know, the labor contract between the parties ended on July 1st, 2014, and has yet to be re-negotiated.  The PCS originally published on May 28, 2014 clearly states that this surcharge was a forward filing, conditioned on “increased port congestion due to potential labor issues.”

As the PCS was published in May 28, 2014, this surcharge complies with Federal Maritime Commission (FMC) requirements that any new rate that results in an increased cost to a shipper may become effective thirty (30) days after publication.  See 46 U.S.C. § 40501(e); 46 CFR § 520.8.  We further note that any changes in rates, charges, rules, regulations or other tariff provisions resulting in a decrease in cost to a shipper may become effective upon publication.  See 46 CFR § 520.8(4).

Again, we appreciate your patience and understanding during these challenging times.  It is important you understand that container movement, either inbound or outbound, is contingent on paying this surcharge as it is being assessed by the carriers.  We are committed to working with you to help minimize the impact of the current West Coast labor issues.

Please contact your local sales representative if you have any questions.

Sincerely,

Carotrans International

CaroTrans Addresses U.S. West Coast Supply Chain Risk with Alternative Routing Options

CaroTrans Addresses U.S. West Coast Supply Chain Risk with Alternative Routing Options

– West Coast readiness program to minimize supply chain disruption –

Clark, New Jersey, November 13, 2014CaroTrans, a leading global NVOCC (non-vessel operating common carrier) and ocean freight consolidator, today announces their U.S. West Coast port readiness program to address potential supply chain disruptions.  Congestion and current labor issues are impacting the flow of cargo at U.S. West Coast ports and there is the likelihood of further instability.  To address this infrastructure challenge, CaroTrans has developed alternative routing solutions to lessen the impact on supply chains and reduce variable transit costs such as detention and demurrage.  Reducing unknown freight costs and working to ensure freight is delivered in a timely manner is critically important to a business’ bottom-line.  CaroTrans’ comprehensive U.S. network includes local teams at 14 U.S. offices and 23 CFS (container freight stations) who provide dedicated support for freight moving throughout the U.S.

Export routing alternatives bypassing U.S. West Coast:

1. West Coast export freight to depart via Houston or U.S. East Coast ports

2. Pacific Northwest freight departs New York

3. Chicago/Midwest cargo departs from U.S. East Coast

U.S. West Coast contract negotiations between the ILWU (International Longshore and Warehouse Union) and PMA (Pacific Maritime Association) are exacerbating ongoing congestion issues caused by surges in cargo volumes from growing imports and bigger ships; shortages of chassis and rail cars; added ILWU safety equipment safety checks; vessel bunching; the need for extended gate hours; low productivity and an insufficient numbers of truck drivers.  Long term, CaroTrans will continue to address these congestion issues which will not be resolved overnight.

“Our job is to minimize the impact of supply chain disruptions on our customers’ business and help them keep their shipper customers’ freight moving in a timely manner.  Current congestion at West Coast ports and labor upheaval is an added burden that is costly, reduces productivity and hinders success.  Our infrastructure challenges require sustainable solutions that will support global competitiveness and improve productivity,” said Greg Howard, global CEO of CaroTrans.
